Terms and Conditions – General Terms and Customer Information

2. Scope

These General Terms and Conditions (“T&Cs”) apply to all purchase contracts concluded by consumers (§ 13 of the German Civil Code – BGB) via our online shop www.terranatura.de.
We currently deliver exclusively within Germany.

3. Contract Language and Storage of the Contract Text

The contract language is German.
We do not store the contract text permanently. You may print or save the order details directly before placing the order.
After submitting the order, you will receive an email with confirmation of receipt and the contract, including all order details, these T&Cs, and the cancellation policy.

4. Ordering Process & Conclusion of Contract

The product presentations in the shop are non-binding.
You place items in the shopping cart and proceed through the Shopify checkout (Information → Shipping → Payment → Review & Order).
By clicking the “Buy Now” button, you submit a binding offer (§ 145 BGB).
The contract is concluded when we accept your offer within two working days by sending a shipping confirmation or delivering the goods.

5. Prices & Shipping Costs

All prices are final prices including statutory VAT.
We charge a flat shipping fee of €3.90 per order.
For orders of €49.00 or more, we deliver free of shipping costs within Germany.
The costs are displayed in the shopping cart and during checkout.
Coupons or promotional discounts are applied according to the respective stated conditions.

6. Payment Methods & Due Date

You can pay using the payment methods shown during checkout via Shopify Payments (e.g., credit card, Klarna Pay Now, instant bank transfer, Apple Pay, Google Pay) or PayPal.
Your payment method will be charged immediately after completion of the order.

7. Delivery Conditions

We dispatch within 2 working days after conclusion of the contract via Deutsche Post / DHL to the address you provide.
The delivery time is 2–4 working days from the conclusion of the contract.
Deliveries are only possible within Germany.
If delivery is not possible, we will inform you immediately and refund any payments already made.

8. Retention of Title

The goods remain our property until full payment has been received (§ 449 BGB).

9. Right of Withdrawal

Consumers have the following statutory right of withdrawal.

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

by means of a clear statement (e.g., letter or email) about your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

Effects of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the standard delivery offered by us), without undue delay and at the latest within 14 days from the day we receive notice of your withdrawal.
We will use the same payment method for the refund that you used in the original transaction, unless expressly agreed otherwise with you.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods – whichever is earlier.

You must return or hand over the goods to us without undue delay and in any case no later than 14 days from the day you inform us of your withdrawal. You bear the direct costs of returning the goods.

10. Statutory Warranty

The statutory rights regarding liability for defects apply.
For goods with a limited shelf life (toothpaste), the expiry of the best-before date does not affect your warranty rights.

11. Liability

We are fully liable for intent and gross negligence as well as under the provisions of the German Product Liability Act.
In the case of slight negligence, we are only liable for damages resulting from injury to life, body, or health or from the breach of a material contractual obligation (cardinal obligation); in such cases, liability is limited to the foreseeable, typical contractual damage.

12. Alternative Dispute Resolution / ODR

The European Commission provides a platform for online dispute resolution (ODR) at: https://ec.europa.eu/consumers/odr.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

13. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection regulations remain unaffected.

Should any provision of these T&Cs be wholly or partially invalid, the validity of the remaining provisions shall not be affected.
